This “Privacy Policy” describes how your Personal Information (defined below) is collected, used, and shared when you visit any websites owned and operated by Her Campus Media LLC  (each a “Site”, and collectively the “Sites”) and that post this Privacy Policy. The Sites are operated by Her Campus Media LLC, and throughout this Privacy Policy, the terms “we”, “us” and “our” refer to Her Campus Media LLC. 

This Privacy Policy is incorporated into and subject to our Terms of Use.  By visiting the Sites or submitting Personal Information (defined below) to us, you agree to the terms and conditions of this Privacy Policy, and you expressly consent to the collection, use and disclosure of your Personal Information in accordance with this Privacy Policy.  Please note that certain features or services referenced in this Privacy Policy may not be offered on the Sites at all times.

You are not obligated to provide your Personal Information to us as described in this Privacy Policy, however, without it, we may not be able to provide you with our products and services.

Personal Information means any information that may be used to identify an individual, including, but not limited to, a first and last name, a physical address, an email address, or other contact information including, gender, occupation, personal interests, or other similar information.

PERSONAL INFORMATION WE COLLECT

Information We Collect Automatically. When you visit a Site, we automatically collect certain information including information about your web browser, IP address, location, time zone, and some of the “cookies” that are installed on the device through which you accessed the Sites. Additionally, as you browse a Site, we collect information about the individual web pages that you view, what websites or search terms referred you to the Site, and information about how you interact with the Site. We refer to this automatically collected information as “Device Information”.

We collect Device Information using the following technologies:

  • “Log files” track actions occurring on the Site, and collect data including your IP address, browser type, Internet service provider, referring/exit pages, and date/time stamps.

  • “Web beacons,” “tags,” and “pixels” are electronic files used to record information about how you browse the Sites or open our emails.

Information You Provide Directly to Us.  Additionally, we may collect Personal Information that you voluntarily provide to us directly, such as when creating an account on a Site, subscribing to our newsletters, entering into a sweepstakes or contest, completing a survey or otherwise contact us.  This Personal Information may include  your name, email address, phone number, age, gender, and other unique identifiers such as a username and password. We refer to this information as “Account Information”. By submitting your email address to the Sites for any purpose or use, you agree to have this email address included in our email mailing list and to be contacted by us.  As described below, you can opt out of our using your email address for marketing or promotional messages.

You also may provide Personal Information directly to us through your emails to us, Q & A, blogs, comments, surveys, sweepstakes or other contests, in response to polls, or through any other user-generated content (“UGC”) you submit to us.

As a general matter, whenever you directly provide us with your Personal Information, please be sure it is accurate and complete. We cannot be responsible for any information you provide to us that is incomplete or incorrect.

Contests and User Sampling. We collect data from contest participants and sampling of our users, including names, emails, social media handles, addresses, and possibly demographic information. If you register to participate, you agree to allow us to share your information with a sponsor. We will indicate which company or sponsor is requesting the information. Sites users who have received an invitation to participate in such a contest may opt to not be included and ask that the sponsor purge their Personal Information from their database. All participants are also asked to provide explicit consent for receiving communications (including potential marketing messages) and sharing their data with any necessary third parties to execute these programs. Also, if we obtain prior consent, we may publicize Personal Information (including photos and names) about participants when announcing winners and marketing around the program, including by authorized third parties.  Note that in some jurisdictions, we are required to publicly share information of sweepstakes and contest winners.

Information Collected from Other Sources. We may obtain information about you from other sources, including social networks that you use to connect with us. If you use a third-party service to login, link to us, or communicate with us (such as a social network or third-party video chat), we may receive certain information about you from the third party based on your registration and privacy settings on those third-party services. This Personal Information may include your name, username, demographic information, updated address or contact information, interests, and publicly observed data, such as from social media and online activity.  If you provide Personal Information to these third parties, including social networks, these organizations’ privacy policies apply to your Personal Information and not this Privacy Policy.

Influencers. We collaborate with influencers to place posts on social media websites and platform. We collect information about their audience, engagement rates, and content preferences. We collect data to measure the impact of influencer posts, tracking metrics like reach, engagement, and conversion rates and to gain insights into the interests and demographics of the influencer’s audience, which helps us to create targeted content.  We will also collect contact details of influencers to communicate with them regarding their services.

Writers. We may invite guest writers to contribute articles to the Sites.  Writers are asked to provide personal and professional information for author profiles on our Sites.  Writers are asked to provide personal and professional information for author profiles that are posted on our Sites or included with a posted article.  Further, we may analyze the performance of articles written by guest writers, tracking metrics such as page views, shares, and reader engagement We will also collect contact details of writers to communicate with them about, for example, article reviews, edits, and updates.

Job Applicants. If you apply for employment with us, we will ask you provide Personal Information, such as your professional credentials, educational and professional history, institutional affiliations, background checks, and information of the type included on a resume or curriculum vitae (such as work experience, education, salary expectation, and languages spoken), as well as contact information to communicate with you about your application.

Marketing Information. We collect your preferences for receiving our marketing communications and details about your engagement with them.

HOW DO WE USE YOUR PERSONAL INFORMATION?

Account Information. We use the Account Information that we collect generally to run the Sites, providing any services, sending you email updates and newsletters, responding to customer service requests, administering promotions and sweepstakes or other contests, user sampling and sending you our marketing communications. 

Device Information. We use Device Information that we collect to help us screen for potential risks and fraud, and more generally to improve and optimize our Sites (for example, by generating analytics about how our users browse and interact with each Site, and to assess the success of our marketing and advertising campaigns).

Advertisements. We and our advertising partners may use your Personal Information, including your location and your activities on the Sites to facilitate the delivery of online targeted advertisements to you while on the Sites.

Administrative Purposes. We may use your Personal Information for internal business purposes, such as to improve our operations, services and products; create new products or services; monitor usage of the Sites; and prevent fraud or illegal activity on the Sites, for example. 

SHARING YOUR PERSONAL INFORMATION

Service Providers. We share your Personal Information with third parties who perform services on our behalf for the operation of the Site. These third parties may host the Sites; provider analytics and security, and other administrative services; and email delivery, customer service, and marketing assistance. 

Partners. Some of our Sites may from time-to-time partner with a retailer or other third party to offer online shopping opportunities, contests, games, services, subscriptions and other applications on a co-branded or cross-promotional basis (“Third-Party Promotion(s)”). Those transactions may take place on one of the Sites, or the website of the party offering the Third-Party Promotion. In either case, Personal Information you provide in connection with each Third-Party Promotion may be shared with the applicable third party, as well as with any participating sponsors or advertisers of such opportunities and features. 

Social Media. You may have the option to create an account with us by logging in through a social media account or other third-party service, such as Facebook or Instagram. If you do so, you give us permission to access, store and use any information that you permit the applicable third-party website or service to share with us in accordance with their terms and conditions and policies. We may store and use any information that we receive from those websites and services in accordance with this Privacy Policy. Our social media tools, such as Facebook, Twitter, YouTube, Instagram, Pinterest, and Snapchat widgets, are either hosted by a third party or hosted directly on our Sites. Your activity with these tools is governed by the privacy policies of the companies that provide them. If you give a third- party service permission to share with us any of your Personal Information, we will store and use any such Personal Information in accordance with this Privacy Policy.

Analytics Providers. We deploy technologies to track the performance of our overall site as well as ad specific performance data through demographic data about the user and device that visits the Sites, and metrics like time on a Site, scroll depth, click-through rates, impressions, and conversion rates.

Sale of Business or Assets. If another company acquires our company, business, or our assets, that company may then possess the Personal Information collected and stored by us, however, such company will assume the rights and obligations regarding your Personal Information as described in this Privacy Policy. 

Legal Obligation and Protection of Rights. Finally, we may also share your Personal Information to comply with applicable laws and regulations, to respond to a subpoena, search warrant or other lawful request for information we receive.  or to otherwise protect our or others’ rights.

Sale or Sharing of Personal Information. Except as may otherwise be described in this Privacy Policy we do not sell or share your Personal Information to third parties without your explicit and informed consent.

COOKIES AND OTHER TRACKING TECHNOLOGIES

A cookie is a piece of data stored on your computer’s hard drive that contains information about you and your computer. The cookies used on the Sites do not contain any identification that would be useful to another individual or organization. We use cookies, for example, to remember your login information so you do not have to enter a username and password each time you return to Site (should you choose this option). We also use cookies to provide statistical information on site usage and personalize and enhance the online experience. Some of these cookies may be active during the time you are viewing a website (“session cookies”). Other cookies may remain on your computer after you have closed your browser or turned off your computer (“persistent cookies”). We may use tracking cookies on other websites, such as to serve you with targeted online ads.

We use the following types of cookies on the Sites:

  • Strictly Necessary Cookies: These cookies are essential to enable our Sites to provide the function you have requested, such as by helping to ensure that the content of a page loads quickly and effectively.  (You cannot opt out of our use Strictly Necessary Cookies.)

  • Performance Cookies: These cookies allow us to count visits and traffic sources so we can measure and improve the performance of our site. They help us to know which pages are the most and least popular and see how visitors move around the a Site. If you do not allow these cookies we will not know when you have visited a Site and will not be able to monitor its performance.

  • Functionality Cookies: These cookies allow us to provide enhanced personalization and functionality, such as tailoring content to you, remembering your choices and preferences on the Sites (e.g., language, text size, etc.) or remembering search parameters.

We also use web beacons and pixels on our Sites and in emails. For example, we may place a pixel in marketing emails that notify us when you click on a link in the email. We use these technologies to operate and improve our Sites and marketing emails.

INTEREST-BASED ADVERTISING

We may engage third party advertisers, ad exchanges and ad networks to display ads on the Sites. These companies may use cookies, web beacons, pixels and similar technologies to collect information, including Personal Information, about visitors to our Sites, our communications and other online services, and use that information to serve you ads while on the Sites that may interest you. This is called interest-based advertising. In addition, we may create first party and/or third-party audience segments to help us target ads to specific visitor demographics; however, we do not currently retarget our visitors on third-party websites. We may also share information about our visitors to facilitate interest-based advertising to the same or similar visitors on other online platforms not controlled or managed by us. If you wish to subscribe to one or more of our email newsletters, we will ask for you to provide your email address.  

MARKETING AND PROMOTIONAL MESSAGES

We may send you email marketing or promotional messages about our products and services that may be of interest to you. We will request your consent prior to sending you these email marketing or promotional messages or without your consent if we have a legitimate interest to do so. You can modify or opt out of these messages by following the instructions contained within our promotional emails or in some cases by logging into your account and changing your communication preferences. This will not affect subsequent subscriptions, and if your opt-out is limited to certain types of emails, the opt-out will be so limited. 

Please note that we reserve the right to send you certain email communications relating to your account or use of our services available on the Sites, such as administrative and service announcements and these transactional account messages may be unaffected if you choose to opt-out from receiving our marketing email communications.

Please note that we do not alter our Sites’ data collection and use practices when we see a Do Not Track signal from your browser.

LEGAL BASIS

In accordance with applicable data protection laws, we will only process your Personal Information where we have a lawful basis for doing so, such as:

  • Contract Necessity -- Where it is necessary to provide the Services to you under the performance of the contract we have with you or your organization that is our client;

  • Legal Necessity -- Where we are required to do so in accordance with legal or regulatory obligations;

  • Consent -- Where you have given your consent; and,

  • Legitimate Interests -- Where it is in our (or a third party’s) legitimate interests to process your Personal Information and these interests do not prejudice your own interests or fundamental rights and freedoms.

YOUR CHOICES AND RIGHTS

Account holders can access and update their Personal Information and preferences from within their account.

You may also send us an email at info@hercampus.com to request access to, correct or delete any Personal Information that you have provided to us. We cannot delete your Personal Information except by also deleting your user account. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

If we have agreed to receive our marketing or promotional email messages or our email newsletters, you will be able to opt out by using the “Unsubscribe” feature at the bottom of each email from us or by requesting to opt out by emailing us at info@hercampus.com. You can also update your marketing preferences in your account to opt out of receiving marketing or promotional emails.

Please note that you cannot opt out of receiving transactional communications from us regarding services you request, your account with us or other transactional or administrative issues.

You may have certain rights under US or foreign law regarding your Personal Information.  Please see below for a description of these rights and how to contact us about them.

LOCATED IN THE UNITED STATES

The Sites are owned and operated by Her Campus Media LLC in the United States and are governed by US law. If you are outside the United States when you visit the Sites or engage in communications with us, be aware that your Personal Information may be transferred to, stored, and processed by us and/or our third-party cloud providers in the United States. By using a Site, or providing us with any Personal Information, you fully understand and unambiguously consent to this transfer, processing and storage of your Personal Information in the United States, which privacy laws may not be as comprehensive as those in the country where you reside and/or are a citizen. Note also that your Personal Information may be available to the US Government or US law enforcement under appropriate legal processes in the United States.

EUROPEAN ECONOMIC AREA, UNITED KINGDOM OR SWITZERLAND RESIDENTS

If you are an individual in the European Economic Area (EEA), United Kingdom or  Switzerland,  we collect and process Personal Information about you only where we have legal basis for doing so under applicable data protection laws in these countries (the General Data Protection Regulation in the EEA; the UK GDPR in the United Kingdom and the Federal Act on Data Protection in Switzerland). Our legal basis depends on the manner in which you access and use the Sites. This means we collect and use your Personal Information only where:

  • We need it to provide you access to and use of the Sites, to operate the Sites, provide customer support and personalized features and to protect the safety and security of the Sites;

  • It satisfies a legitimate interest (which is not overridden by your data protection interests), such as for research and development, to market and promote our Sites and products and services or to protect our legal rights and interests;

We are the controller of information that you provide in order for us to provide the Sites for your use. You are the controller of any information that is entered during and as part of your use of the Sites, and we are the processor of that information on your behalf. We will process the information according to your instructions, which you give us in the process of visiting and using the Sites.

If you reside in the EEA, United Kingdom or Switzerland, and we do not seek your explicit consent to process your Personal Information, we are relying on the legitimate commercial interest of our company in providing the Sites to you and the need to process your Personal Information, as previously described, in order to accomplish that legitimate interest.

  • Request that your Personal Information be deleted or restricted under certain circumstances. For example, if we are processing your personally identifiable information on the basis of your consent and has no other legal basis to use such, you may request your Personal Information be deleted when you withdraw your consent.

Withdrawing your consent will not affect the lawfulness of any processing we conducted prior to your withdrawal, nor will it affect processing of your Personal Information conducted in reliance on lawful processing grounds other than consent.

DATA RETENTION

We will maintain your Personal Information for as long as needed in order to perform the purposes for which such Personal Information was collected. As described in this Privacy Policy, you may request at any time to access or update your Personal Information, or that we delete any of your Personal Information stored by us, by contacting us at info@hercampus.com. Following any such request, we will take all reasonable steps to provide, modify or delete your Personal Information as soon as is practicable, but some information may remain in archived/backup copies for our records or as otherwise required by law.

SECURITY

Our commitment to data security is an ongoing effort, and we continuously evaluate and update our security measures to address emerging threats and adhere to industry best practices and comply with the emerging legal obligations for companies which collect Personal Information. Our security measures align with the National Institute of Standards & Technology (NIST) Cybersecurity Framework, which establishes a recognized data security program that meets cybersecurity industry best practices that provide a resilient defense against potential risks, ensuring the confidentiality, integrity, and availability of our data and systems.  Our approach aligns with the NIST Framework's core functions: Identify, Protect, Detect, Respond, and Recover.

The security of your Personal Information is important to us but remember that no method of transmission over the Internet, or method of electronic storage is 100% secure. While we strive to use commercially acceptable means to protect your Personal Information, we cannot guarantee its absolute security.

If you establish an account with us, do not provide your login information, including your password, to another person. We cannot be responsible for a data breach or other incident if a password is used by unauthorized persons. You remain responsible for all activity conducted using your account credentials.

CHILDREN

The Sites are not intended for use by children under 13 for US residents and under 16 in the EEA, UK or Switzerland. No one under the age of 13 or 16 as applicable is permitted to access the Sites or provide any Personal Information. We do not knowingly collect or solicit Personal Information from children under 13 (or 16); if you are a child under 13 (or 16), please do not open an account or send any Personal Information about yourself to us. If we learn we have collected Personal Information from a child under 13 (or 16), we will delete that information as quickly as possible. If you believe that a child under 13 (or 16) may have provided us Personal Information, please contact us at info@hercampus.com.

By using any of the Sites, you represent that you are at least the age of majority in your state, province or country of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use the Sites.

If you are a parent or guardian and you are aware that your child has provided us with Personal Information, please contact us. If we become aware that we have collected Personal Information from children under the age of 13 (or 16) without verification of parental consent, we will remove that information from our servers.

CALIFORNIA RESIDENTS

The California Consumer Privacy Act (as amended by the California Privacy Rights Act) (together, the CCPA) gives California consumers enhanced rights with respect to their personal information that is collected by businesses. The CCPA provides California consumers with three rights regarding their personal information.  At or before the time of collection, you have a right to receive notice of our practices, including the categories of Personal Information and any sensitive Personal Information to be collected, the purposes for which such information is collected or used, whether such information is "sold or shared" as defined under the CCPA and how long such information is retained. First, California consumers can opt out of the sale or sharing of their Personal Information with third parties under certain conditions.  See below for more information. 

Second, California consumers can request to know:

  • What specific pieces of Personal Information a business has collected about the consumer;

  • Categories of Personal Information it has collected about the consumer;

  • Categories of sources from which the personal information is collected;

  • Categories of Personal Information that the business sold or disclosed for a business purpose about the consumer;

  • Categories of third parties to whom the Personal Information was sold or shared for a business purpose; and

  • The business or commercial purpose for collecting or selling or sharing Personal Information.

Third, California consumers can request that a business delete Personal Information about the consumer that a business has collected from the consumer and, fourth, request that their Personal Information be corrected.

The CCPA also prohibits covered businesses from providing discriminatory treatment to California consumers if they exercise their rights under the CCPA.

To make a “Request to know”, “Request to Delete” or “Request to Correct’ regarding your Personal Information, please email us at: info@hercampus.com with proof of your California residency. California consumers can use an authorized agent to submit a request on their behalf.  We may request proof that the consumer gave the agent signed permission to submit the request.

We will confirm receipt of your request within 10 business days. We must provide the requested information or delete or correct your Personal Information within 45 days of receipt of your request, but we can use up to an additional 45 days if we let you know that additional time is needed.

Before responding, we must verify that the person making the request is the person about whom we have collected their Personal Information. We may ask you to provide certain, limited Personal Information, such as your name and email address to verify and match your identity with our records and systems. If you have an account with us, we may ask that you verify your identity through our account authentication process. This is also to protect against fraud. We will not retain this Personal Information or use it for any other purpose. 

Also please be advised that we need to search our records and systems only for the preceding 12 months. There may be cases where we do not have any Personal information about you or we are not able to verify your identity for matching purposes. Deleting your Personal Information may result in the closing of your account and inability to access certain areas of the Sites or services. However, you can always re-register at any time.

Do Not Sell or Share Personal Information If you’re a California resident, you have a right to opt-out from the “sale” or “sharing” of your Personal Information with third parties who are not our service providers (as those terms are defined CCPA).
